Terms of use

Last updated: 6 November 2026

1. Purpose

These terms of use (CGU) govern access to and use of the website https://baiteelayla.com (the "Site"), published by the association BAITE ELAYLA (the "Association"). Use of the member area requires acceptance of the terms of use, confirmed by a checkbox at registration.

Payments (membership fees, donations, hall bookings) are governed by the Payment terms; membership by the Membership terms.

2. Access to the Site

The public pages are freely accessible. The member area is reserved for persons whose membership has been approved by the board and whose membership fee is up to date. The Association endeavours to ensure continuous access but may suspend the Site for maintenance, security or force majeure, without compensation.

3. Account

  • You create an account with an e-mail address and a password, or with your Google account.
  • The information provided must be accurate, up to date and concern you personally. An account is strictly personal.
  • You are responsible for the confidentiality of your credentials. Report any unauthorised use without delay to [email protected].
  • You may request the deletion of your account at any time; deletion ends access to member features.

4. Rules of good conduct

It is prohibited in particular:

  • to publish content that is unlawful, insulting, defamatory, hateful, discriminatory, violent, pornographic, or that infringes privacy, image rights or the rights of others;
  • to impersonate another person or to publish a photo that is not your own in your profile;
  • to publish a third party's personal data without their agreement;
  • to use the Site for political propaganda, proselytism or commercial canvassing;
  • to attempt to interfere with the operation or security of the Site (intrusion, bots, automated extraction, circumvention of protections).

5. Members' directory

The directory allows members to find one another and interact. By using it, you undertake to:

  • use it only for personal exchanges between members, in the spirit of the Association;
  • not use it for commercial, advertising or political canvassing, or for fundraising not authorised by the board;
  • not copy, extract, export or disclose to third parties, in whole or in part, the information it contains;
  • respect the wishes of a member who does not want to be contacted.

Any member may ask not to appear in the directory (see the Privacy policy). Any breach may lead to suspension of access to the directory or to the account, without prejudice to the sanctions provided for by the statutes.

6. Publications: announcements and death notices

Prior moderation. Every announcement and every death notice is reviewed and approved by the board before publication. The board may refuse, modify (for formal corrections, with the author's agreement) or remove a publication contrary to the terms of use, the statutes or the law.

Death notices. A death notice is published only with the agreement of the deceased's family. The person submitting it declares that they act with that agreement and hold the necessary authorisations for the photos submitted; the person named as the family contact must have agreed to the publication of their contact details. The family may at any time request the modification or removal of the notice at [email protected]; removal takes place at the latest within 72 hours.

Announcements. The author is responsible for the content of their announcement and warrants that they hold the rights to the texts and images published. The board may limit the publication period of an announcement.

Licence. By publishing content, you authorise the Association to reproduce and distribute it on the Site, in its three languages, for the duration of its publication. You may request its removal at any time.

Removal and information. Where the Association refuses or removes content, it informs the author and states the reasons, in accordance with article 17 of Regulation (EU) 2022/2065. The author may contest this decision by writing to [email protected].

Reporting. Any user may report content following the procedure described in the Legal notice (section 7).

7. Donation causes

Donation-cause pages are published by the board, with the written agreement of each beneficiary, who may request the removal of their page at any time. They state only the beneficiary's first name, the goal and the progress of the collection. The rules relating to donations are set out in the Payment terms.

8. Liability

The Association uses reasonable means to ensure the accuracy of the information published and the security of the Site, without being able to guarantee the total absence of errors or interruptions. It is not liable for:

  • content published by members, subject to its moderation and removal obligations;
  • exchanges between members via the directory or messaging, or the commitments they make to one another;
  • damage resulting from use of the Site contrary to the terms of use or from a security defect in the user's equipment;
  • third-party services (Stripe, Google, linked sites).

Nothing in the terms of use limits the Association's liability where the law prohibits it.

9. Intellectual property

The platform (code, architecture, interfaces, graphic elements) was designed and developed by Polene Tech, which retains the rights to it; its use is licensed to the Association. The Association's name, logo and content belong to it. Any unauthorised reproduction or extraction is prohibited.

10. Links

The Site may contain links to third-party websites. The Association exercises no control over these sites and is not responsible for their content. Any link to the Site is permitted provided it does not damage the Association's image; the Association may request its removal.

11. Suspension and exclusion

In the event of a breach of the terms of use, the board may, after inviting the person concerned to explain themselves (except in urgent cases), suspend access to all or part of the features or to the account. Exclusion from the Association follows the procedure laid down by the statutes.

12. Changes to the terms of use

The Association may amend the terms of use. Members are informed of any significant change at least 15 days before it comes into force, by e-mail or notification. Continued use of the Site constitutes acceptance of the new terms.

13. Applicable law and disputes

The terms of use are governed by French law. In the event of a difficulty, first contact the Association at [email protected] to seek an amicable solution. Failing that, the dispute is brought before the competent French courts; if you are a consumer, you may bring the matter, at your choice, before the court of the place where you resided at the time the contract was concluded or the harmful event occurred.
